What is Buyer Agency?

If you are buying or selling a property, there is a choice of relationships with real estate brokers and agents. It is important to know who the agents are representing in a transaction. As buyer agents we are able to represent the buyer in every home purchase. By law, an Agency Disclosure form must be presented to the consumer so you have a clear understanding of your choices.

Agency

The relationship established when a broker represents a client is called Agency. When an agency is created, the sales agent will work in your best interests and be loyal to you. Your agent has an obligation to protect your confidentiality, keep you informed and do the best job possible to meet your housing needs. When it comes time to negotiate the deal, your sales agent will be on your side advising you and helping you get the right terms.

Changes

In the past, sales agents represented the seller as their client, and only helped the buyer as their customer. Even the agent who was showing many homes to the buyer actually represented the seller. This way of doing business has changed. As an exclusive buyer agency, we can offer a dedicated buyer agency representation to you.

How to Create Buyer Agency

If buyer agency is your choice, you may review a Buyer Agency Agreement. This agreement between the parties is then signed and will entitle you to Client Level Services and a commitment to quality performance by Firecrest Realty. Once the agreement is signed, both parties are obligated to work exclusively together in the market area. Plus, you will have the service of the entire Firecrest Realty office.

If You Are Not Sure

Most buyers have some confusion about choosing Buyer Agency. They are not sure that they want to be obligated to work exclusively with an agent. On the other hand, the idea of having someone designated as a Buyer Agent is appealing. It is our recommendation to use Buyer Agency to your advantage so that you can feel comfortable knowing your best interest is served at all times.

Dual Agency

It is possible for a broker to work for both the buyer and seller on the same property provided that the broker obtains the consent of both parties. In this case, the broker is considered a Disclosed Dual Agent. The broker owes the seller and the buyer a duty to deal with them fairly and honestly. As excusive buyer agents, we do not see this as an advantage to the buyer. This is why we do not participate in dual agency. Note that in dual agency the broker must disclose this agency by law.

What Do Sellers Think of Buyer Agency?

Sellers want to get their property sold and generally cooperate with Buyer Agents. It's to their advantage to have their home shown to the most number of prospects. This creates a win-win situation where the price and terms are fair to both parties.
